Terms of Service
These terms and conditions are a public offer and govern the relationship between 10GbVPS (the Company) and the client. This offer contract does not require signing in writing. Ordering and paying for services means full acceptance of the terms and conditions below. The company reserves the right to amend the rules for the provision of services unilaterally and without notice to customers.
Prohibited:
- Software and content contrary to the laws of the country of location;
- Sites for the sale of goods that contradict the laws of the country of location;
- pornography involving minors, animals (zoo), incest;
- materials of an erotic and pornographic nature (adult), including links to them, except in countries where this is permitted by law;
- phishing / fake, malware, farma, replica, IRC services, including links to them;
- Theft and hacking of sites, "bakeries", crack / hack and other similar activities;
- port scanning, brute force, proxy checkers and other similar software;
- fraudulent sites, HYIP projects, including links to them;
- any viruses, exploits, including links to them;
- any spam, grabbing, botnets, xrumer, submitter and any other similar software;
- use ip addresses that do not belong to you;
- resources distributing "spice" and other narcotic substances;
- resources calling for interracial and ethnic hatred;
In the case of complaints (abuse) and depending on the nature of the violation, the company reserves the right to apply one of the following measures in relation to the client:
- provide 24 hours to correct violations without blocking services
- block services until the violation is corrected
- disable services without returning unused funds
In some cases, the client additionally pays a fine if his actions directly or indirectly led to company losses.
Rights and obligations of the client
- The client is obliged to comply with all the rules and requirements described in this agreement.
- The client is obliged to notify the company of the refusal to extend the lease of a dedicated server 15 days before the end of the lease term through the ticket system.
- When communicating with company employees through the ticket system, online chat, phone and other means of communication, the client is obliged to communicate and behave within the framework of generally accepted ethical and moral standards.
- The client has the right to return unused funds.
- The client has the right to free technical support ensuring the availability, availability of the services provided and their compliance with the stated parameters.
- The client has the right to basic free administration services according to the list of services only with a control panel.
- The client has the right to defer payment at the discretion of the company.
Company rights and obligations
- The company reserves the right to amend the rules for the provision of services unilaterally and without notifying customers.
- The company reserves the right to suspend the client’s account or server for the duration of technical work, DDOS attacks, natural disasters and force majeure.
- The company reserves the right to delete a virtual hosting account or VPS server on the 10th day, after an overdue payment. Data on the account is returned only after payment of an expired period.
- By the decision of the administration, photocopies of passport data or other identification documents may be requested from the client.
Guaranteed Services
- The company guarantees the conformity of resources stated in the tariffs, as well as the absence of overselling.
- The company guarantees compensation for downtime through the fault of the Company. Compensation is accrued exclusively in the form of additional days in a 5-fold amount for each day of equipment downtime and extends to hosting and VPS services.
- The company guarantees UpTime networks of 99%, except in cases related to equipment maintenance and software updates, DDOS attacks, natural disasters and force majeure, as well as downtime caused by customer actions.
- The company guarantees minimum 50 Mbit per each KVM VPS
- The company guarantees 7 day refund per client request (CryptoCurrency payments are non refundable). All our subnets blocked in Turkmenistan and Iran, inaccessibility IP in current region is not the sufficient reason for a refund.
Each service comes with main IP which is not changeable during all billing cycle. In case you need another IP you can always order additional one. We do not offer IP or location change option after order confirmed
Limitation of liability
- The company is not responsible for the client choosing the OS, software, tariff and the consequences that this may entail.
- The company is not liable for any type of direct or indirect damage, the operation of third-party software or services, loss of business reputation or financial losses associated with interception, data loss, DDOS attacks and other circumstances related or not to the client’s actions due to server downtime.
- The company does not have access to the contents of the client’s servers and does not check for compliance of the content with these terms and conditions, with the exception of cases of well-grounded complaints from third parties.
- The company is not responsible for the delay in the installation of dedicated servers for reasons beyond the control of the company.
Refusal to provide / render services
- The company reserves the right to refuse to provide services to the client in case of indecent and abusive treatment, degrading the honor and dignity of the employee (s) of the company.
- The company reserves the right to terminate the provision of services (at its discretion) if the client violates one or more paragraphs of these rules.
- The company reserves the right to prohibit the placement of materials that, in our opinion, are not acceptable from the point of view of the universal principles of humanism.
Intellectual Property Complaints
- The company has no right to establish the presence or absence of an offense. Only the relevant judicial and law enforcement authorities are authorized for this.
- Filing a complaint about a violation of intellectual rights provides the copyright holder with the opportunity to protect their exclusive rights and provides for the forwarding of the complaint to the owner of the hosting service, the provision of time for a response and the decision to block the hosting service based on the results of the response provided by its owner.
- The site owner has 24 hours to respond from the moment the complaint was forwarded by our company. If the complaint is ignored, our company has the right to block the site until a response is received from the client.
IP Reputation and Blacklist Policy
10GBVPS by BlueVPS actively works to prevent spam-related abuse and protect the reputation of its network. We monitor IP addresses through multiple blacklist and reputation services and investigate activity that may indicate spam, abuse, or other policy violations.
Our abuse team regularly reviews blacklist listings and, where appropriate, submits delisting requests to help maintain a clean and reliable IP space for customers.
Blacklists We Monitor
We monitor major and widely recognized blacklist providers, including, but not limited to:
- Spamhaus, including XBL and PBL
- SpamCop
- Barracuda Reputation Block List
- Abusix Mail Intelligence
- all.s5h.net
If an IP address appears on one of these databases, we will normally review the reason for the listing. Depending on the circumstances and the procedures of the blacklist provider, we may take corrective action or submit a delisting request.
Spamhaus PBL Clarification
Spamhaus PBL, or Policy Block List, is not a traditional spam blacklist. It is a policy-based list that includes dynamic, residential, and other IP ranges that are not intended to send email directly through unauthenticated SMTP connections.
A PBL listing does not indicate that spam or abuse has occurred. It also does not normally prevent email delivery when messages are sent through a properly configured mail server or relay using authenticated SMTP services, including SMTP AUTH.
For VPS and similar hosting IP ranges, PBL listings may be normal and usually do not require removal.
Third-Party Email Reputation Systems
Some email security and filtering services use their own internal reputation scores, behavioral analysis, recipient-side rules, and proprietary filtering methods rather than public blacklist databases.
Proofpoint and similar platforms are not standard public DNS-based blacklists. Their decisions are based on systems and policies that are outside the control of 10GBVPS by BlueVPS.
Therefore:
- A standard delisting process may not be available.
- Reputation changes depend on the external provider or recipient.
- 10GBVPS by BlueVPS cannot guarantee the removal of listings or filtering restrictions.
Network-Level Blacklists
Some blacklist providers list entire IP ranges, subnets, or autonomous systems instead of individual IP addresses. Such listings may be based on activity associated with the wider network.
Examples include:
- UCEPROTECT Level 2
- UCEPROTECT Level 3
- ivmSIP24
Listings that affect a full subnet, IP range, or ASN are generally outside the direct control of the hosting provider. They do not necessarily mean that abuse originated from the specific IP address assigned to a customer.
Requests for an IP replacement based only on these network-level listings will be declined.
Newly Assigned IP Addresses
If a newly purchased VPS or server is assigned an IP address that appears on a blacklist, please contact our support team.
We will review the listing and, where possible, submit a delisting request to the relevant provider.
Please note:
- Delisting depends entirely on the policies and procedures of the blacklist operator.
- 10GBVPS by BlueVPS cannot guarantee removal from any third-party blacklist or reputation system.
- Some listings may remain active even after the issue has been investigated or resolved.
IP Reputation and Blacklist Policy
At BlueVPS, we actively fight spam-related abuse and maintain a strict policy to ensure the integrity of our network. We continuously monitor IP reputation across multiple blacklist and reputation providers and take proactive measures to investigate and mitigate any suspicious or abusive activity.
Our abuse team regularly reviews listings and submits delisting requests where appropriate in order to maintain a clean and reliable IP space for all customers.
Common Blacklists We Monitor
We monitor and respond to listings on major and widely recognized blacklist providers, including but not limited to:
- Spamhaus (XBL, PBL)
- SpamCop
- Barracuda Reputation Block List
- Abusix Mail Intelligence
- all.s5h.net
If an IP address is listed on one of these databases, we will typically investigate the cause and, if necessary, take action or submit a delisting request depending on the provider’s procedures.
Spamhaus PBL clarification
Please note that Spamhaus PBL (Policy Block List) is not a spam blacklist. It is a policy-based list that includes dynamic and non-mail-enabled IP ranges that are not intended for direct SMTP email sending.
Being listed on the PBL does not indicate abuse or spam activity and does not prevent email delivery when using authenticated SMTP services (SMTP AUTH) through a properly configured mail server or relay.
In most cases, PBL listings are expected for VPS and similar IP ranges and do not require delisting.
Email Security and Third-Party Reputation Systems
Some email security and filtering systems operate independently from public blacklist databases and may apply their own internal reputation scoring, filtering rules, or behavioral analysis.
Proofpoint and similar systems are not traditional public DNS-based blacklists. They operate using proprietary reputation models and recipient-side filtering rules, which are outside the control of BlueVPS.
As a result:
- Delisting from these systems cannot always be requested in a standard way
- Reputation changes depend on external providers and recipient-side policies
- BlueVPS cannot guarantee resolution of listings or filtering decisions within such systems
- Provider-Wide and Network-Level Blacklists
Some blacklist providers operate on a different model and may list entire IP ranges, subnets, or autonomous systems (ASNs) rather than individual IP addresses based on aggregated or network-level activity.
Examples include:
- UCEPROTECT Level 2
- UCEPROTECT Level 3
- ivmSIP24
Listings affecting entire IP ranges, subnets, or ASN networks (such as UCEPROTECT Level 2/3 or ivmSIP24) are generally outside the control of the hosting provider and do not necessarily indicate abuse originating from the assigned IP address. IP replacement requests based solely on such listings will be declined.
Newly Assigned IP Addresses
If you have just purchased a VPS or server and discover that your newly assigned IP address is listed on a blacklist, please contact our support team.
We will review the listing and, where possible, submit a delisting request to the relevant blacklist provider on your behalf.
However, please note:
- Delisting is fully dependent on the internal policies and procedures of the respective blacklist operator.
- BlueVPS cannot guarantee successful removal from any third-party blacklist or reputation system.
- Some listings may persist even after mitigation actions have been taken.
IP Replacement Policy
BlueVPS does not automatically replace IP addresses based solely on blacklist status.
We do not offer refunds or compensation for IP addresses listed on third-party blacklist or reputation systems.
